Agreement

By downloading, installing, or using Cadence ("the App"), you agree to these Terms of Service. If you do not agree, do not use the App. Cadence is operated by the Cadence research team ("we", "us", "our"), based in Ontario, Canada.

Eligibility

You must be at least 18 years old to use Cadence. By using the App, you represent that you meet this requirement.

The Service

Cadence is a research application that records movement sensor data (accelerometer, gyroscope, magnetometer) and GPS location during walking sessions. The data is used to study gait patterns and support neurological health research. The App is provided for research and personal tracking purposes only.

Your Account

You register with an email address and authenticate via a one-time verification code. You are responsible for maintaining the security of your account and device. Notify us if you suspect unauthorized access.

Research Consent

Cadence+ features (health profile questionnaire) require your explicit consent to collect and use health-related data for research. You can withdraw consent at any time through the App. Withdrawal does not affect the lawfulness of data processing performed before withdrawal.

Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract source code from the App
  • Interfere with or disrupt the App's servers or infrastructure
  • Create accounts using automated methods or false information
  • Use the App to collect data about other individuals without their consent

Intellectual Property

The App, its design, code, algorithms, and branding are owned by us and protected by intellectual property laws. Your use of the App does not grant you ownership of any content or materials. You retain ownership of data you generate through your sessions.

Not Medical Advice

Cadence is a research tool, not a medical device. Data, insights, or metrics provided by the App (including step counts, distance, pace, and gait analysis) are estimates and should not be used to diagnose, treat, or prevent any health condition. Always consult a qualified healthcare professional for medical advice.

Availability & Changes

We aim to keep Cadence available and functional but do not guarantee uninterrupted access. We may update, modify, or discontinue features at any time. We will make reasonable efforts to notify you of material changes.

Limitation of Liability

The App is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the App. Our total liability is limited to CAD $100.

Termination

We may suspend or terminate your access at any time if you violate these terms. You may stop using the App at any time. Upon termination, you may request deletion of your data by contacting us.

Governing Law

These terms are governed by the laws of Ontario, Canada. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be subject to the jurisdiction of the courts of Ontario.

Changes to These Terms

We may update these terms from time to time. Material changes will be communicated through the App or via email with at least 30 days notice. Continued use after changes take effect constitutes acceptance.

Privacy

Your use of Cadence is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
